1. Agreement to Terms
By accessing or using Happiness ("Service," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.
2. Description of Service
Happiness is a travel social application that lets users follow other travelers, browse trip itineraries on a map, and publish their own trips with locations, photos, routes, and recommendations. It also includes tools for booking travel on third-party websites, described in section 6. Our Service includes mobile applications, web applications, and related features.
3. User Accounts
To use certain features of our Service, you must create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
- Providing accurate and complete information
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights of others
- Upload malicious code, viruses, or harmful content
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Service
- Harass, abuse, or harm other users
- Use the Service for any illegal purpose
- Post objectionable content, including content that is sexually explicit, hateful, violent, threatening, or defamatory
There is no tolerance for objectionable content or abusive users. You can report content or users and block users from within the app. We review reports within 24 hours, and we remove content that breaks these Terms and may suspend or terminate the accounts responsible.
5. Your Content
You retain ownership of all content you publish on Happiness ("Your Content"), including itineraries, photos, locations, notes, and comments. By using our Service, you grant us a limited license to:
- Store and process Your Content to provide the Service
- Create backups for disaster recovery
- Display Your Content to other users according to the visibility settings you choose (public, followers only, or only you)
We do not claim ownership of Your Content and will not use it for any purpose other than providing the Service. Trips you publish publicly may be visible to anyone using the Service; trips shared with followers are visible only to followers you approve.
6. Booking Tools and Third-Party Sites
Happiness includes an in-app browser for visiting airline, hotel, and other travel websites, a Traveler Vault that stores your travel details on your device, Autofill, which fills those details into booking forms, and Save booking, which keeps a summary of a booking in your account.
- Happiness is not a travel agent and is not a party to any booking. Bookings, payments, changes, cancellations, and refunds are between you and the provider, under the provider's own terms and privacy policy.
- Autofill uses automated matching, including AI, and can put a detail in the wrong field or miss one. Check every field on the provider's page before you pay. You always choose whether to submit a form or pay.
- Booking summaries and flight or hotel search links are provided for convenience and may be incomplete or out of date. The provider's confirmation is the record of your booking.
- You are responsible for the accuracy of the details in your Traveler Vault, and for having permission to save and use the details of other travelers you add.
- We don't control third-party websites and are not responsible for their content, availability, or practices.
7. Intellectual Property
The Service and its original content (excluding Your Content), features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.
8. Payment Terms
Happiness is currently free for travelers. If you subscribe to a paid plan we may offer in the future:
- Fees are billed in advance on a monthly or annual basis
- All fees are non-refundable except as required by law
- We may change pricing with 30 days' notice
- You are responsible for all applicable taxes
9. Termination
We may terminate or suspend your access immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:
- Your right to use the Service will cease immediately
- You may request export of Your Content within 30 days
- We may delete Your Content after 90 days
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting on our website or sending you an email. Continued use of the Service after changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms shall be governed by the laws of the State of California, United States, without regard to its conflict of law provisions.
